Design Sets Licenses

1. PERSONAL (NON-COMMERCIAL) LICENSE

1. Permitted Uses

Under this Personal (Non-Commercial) License, you (the Licensee) may:

  • Use the purchased digital graphics (“Assets”) solely for personal, non-commercial projects.

    • Examples include personal art projects, hobby designs, or school assignments.

  • Display or share end products (e.g., personal social media posts, personal prints, or gifts) that incorporate the Assets, as long as you do not make money or otherwise profit from them.

2. Restrictions

You may not:

  • Use the Assets in any commercial context, including (but not limited to) advertising, marketing, corporate branding, or any project that directly or indirectly generates income.

  • Resell, sublicense, share, gift, or redistribute the Assets in their original or modified forms.

  • Claim the Assets as your own or register them as a trademark, service mark, or any intellectual property.

  • Use the Assets on “print-on-demand” services (e.g., Redbubble, Society6) or in any physical or digital product you offer for sale or distribution.

3. Ownership & Copyright

  • All rights, titles, and interests in and to the Assets remain exclusively with Gelmir.

  • Purchase of this license grants you only the limited right to use the Assets as specified above; no other rights are granted.

4. Liability & Indemnity

  • The Assets are provided “as is.” Gelmir will not be held liable for any damages resulting from the use or misuse of the Assets.

  • You agree to indemnify and hold harmless Gelmir from any claims, damages, or liabilities arising from any breach of this license by you.

 

 

2. COMMERCIAL LICENSE

1. Permitted Uses

Under this Commercial License, you (the Licensee) may:

  • Use the purchased digital graphics (“Assets”) for commercial projects such as:

    • Client work (e.g., branding, advertisements, product packaging).

    • Marketing materials (e.g., brochures, posters, social media ads).

    • Editorial use (e.g., magazines, newspapers, online publications).

  • Incorporate the Assets into end products for sale provided the Assets form part of a larger, original design and are not the primary, standalone value of the product (e.g., using an illustration as part of a t-shirt design, but not selling the raw Assets themselves).

2. Usage Limitations

  • Print Run / Production Cap: The total number of reproductions (e.g., prints, merch items) under this license is limited to 10.000 units. If you need more, consider the Extended Commercial License.

  • Digital Audience: You may use the Assets across unlimited digital platforms (websites, social media, apps) as part of your commercial projects.

3. Restrictions

You may not:

  • Resell, sublicense, share, gift, or redistribute the original or modified Assets as standalone files in any format.

  • Claim the Assets as your own or register them as a trademark, service mark, or any intellectual property.

  • Use the Assets in on-demand platforms (e.g., “print-on-demand”) where the Assets are the main design without significant alteration or addition.

4. Ownership & Copyright

  • All rights, titles, and interests in and to the Assets remain with Gelmir.

  • You receive a limited, non-exclusive, non-transferable, worldwide license to use the Assets for the permitted commercial purposes.

5. Liability & Indemnity

  • The Assets are provided “as is.” Gelmir will not be liable for any damages resulting from the use or misuse of the Assets.

  • You agree to indemnify and hold harmless Gelmir from any claims, damages, or liabilities arising from any breach of this license by you.

 

 

3. CORPORATE LICENSE

1. Permitted Uses

Under this Corporate License, you (the Licensee) may:

  • Use the purchased digital graphics (“Assets”) for unlimited commercial projects, including large-scale ventures. Examples include:

    • High-volume product production (e.g., unlimited merchandise, packaging).

    • Broadcast, film, TV, and streaming for set design, props, marketing materials, or other production needs.

    • Game development (e.g., backgrounds, elements for in-game assets).

    • Large-scale advertising campaigns without limit on distribution or impressions.

  • Modify and adapt the Assets to fit project needs, as long as such modifications do not infringe on Gelmir’s copyrights.

2. Usage Limitations

  • There are no specified numerical caps on print runs, merchandise, or total sales under the Corporate License.

  • Digital distribution: You may integrate the Assets into apps, games, or other software, provided they are not distributed as stand-alone Assets.

3. Restrictions

You may not:

  • Resell, sublicense, share, gift, or redistribute the Assets (in original or modified form) as standalone files or in a manner that directly competes with Gelmir.

  • Claim the Assets as your own or register them as a trademark, service mark, or any form of intellectual property (unless you have a written agreement stating otherwise).

  • Make the Assets publicly available in any way that allows others to extract or reproduce them as separate files (e.g., providing layered source files).

4. Ownership & Copyright

  • All rights, titles, and interests in and to the Assets remain with Gelmir.

  • You receive a limited, non-exclusive, non-transferable, worldwide license to use the Assets for the permitted extended commercial purposes.

5. Liability & Indemnity

  • The Assets are provided “as is.” Gelmir will not be liable for any damages resulting from the use or misuse of the Assets.

  • You agree to indemnify and hold harmless Gelmir from any claims, damages, or liabilities arising from any breach of this license by you.
